PEAK LEGAL PRIVACY POLICY

This privacy policy explains what information we collect about you, what we use that information for, and to whom we give that information. It also describes your rights regarding your information and who you can contact for more information or questions.

1. SUBJECT This privacy policy regulates the processing of your personal data by PEAK LEGAL BV, with its registered office at Kortrijksesteenweg 1168 bus 0101, 9051 Ghent, and with company number 0738.669.054, and by any lawyer within the Peak Legal association (hereinafter ‘Peak Legal’ or ‘we’). 2. WHAT DATA? Peak Legal is the ‘controller’ of your personal data within the meaning of the General Data Protection Regulation. This concerns all information about an identified or identifiable natural person (“you” or “the data subject”); such as a name, an identification number, location data, an online identifier or one or more elements characteristic of the physical, physiological, genetic, psychological, economic, cultural or social identity of that natural person (hereinafter the ‘Personal Data’). The Personal Data we actually process is explained below.

We obtain knowledge of your Personal Data in the following circumstances:

  • When you visit our website (www.peaklegal.be);

  • When you provide this Personal Data to Peak Legal in the context of our activities or other professional activities (e.g., networking events, seminars, receptions, etc.);

  • When other parties transfer your Personal Data to us due to the handling of a file assigned to us;

  • or

  • When we obtain this Personal Data from publicly accessible data sources (e.g., LinkedIn, other social media, public databases, etc.).

The following Personal Data is standardly processed by Peak Legal:

  • Name (first and last name, company name)

  • Gender

  • Date and place of birth

  • Profession

  • Address

  • Billing information

  • Telephone, mobile, fax number

  • E-mail address, website

  • Contact person details for your file

  • KBO/BTW number, national register number

  • Bank account number

Depending on the type of file, the following Personal Data may be additionally processed:

  • Financial and tax information;

  • Employment law information (e.g., employer details, job title, training, etc.);

  • Information concerning your family situation and/or matrimonial property (matrimonial regime, heirs and representatives, etc.);

  • Other information you provide to us in the context of your file.

3. WHAT IS THE DATA USED FOR? We process your Personal Data to provide you with quality services, manage your files, and comply with our legal obligations. We may process your Personal Data in the context of providing legal services to our client (e.g., sending a notice of default). Your Personal Data will only be processed to the extent and for as long as necessary for the representation of our client's interests. You can always contact us to exercise your rights in this regard as set out below in point 8.

The Personal Data is used for, among other things, the following:

  • As lawyers, we act as legal advisors, representatives in court or for other purposes, and in the execution of this assignment, we must process various forms of information, documentation, and also Personal Data.

  • In the execution of the aforementioned assignment, we sometimes need to contact authorities, bailiffs, and/or other actors in the justice system, whereby Personal Data may also be processed.

  • Finally, we may also process your Personal Data as a result of your visit to our website (www.peaklegal.be). More information about this type of processing can be found below under point 9.

All Personal Data is also subject to professional secrecy as part of our deontological obligations as lawyers. Violation of professional secrecy is punishable under Article 486 of the Criminal Code. For these reasons, it is possible that your data is already being processed before we can provide you with the information in this privacy policy.

4. LEGAL BASIS FOR PROCESSING We are legally obliged to state in this privacy policy the legal grounds on which we base the processing of your Personal Data. These legal grounds are:

  • legal and regulatory obligations to which Peak Legal is subject, such as keeping records for regulatory or tax purposes or providing information to a government agency or legal authority, to comply with our obligations in the field of "anti-money laundering practices" (or other legal obligations imposed on us);

  • our contractual relationship: we process your data to provide our services to you or our client, or to contact you in response to a specific request (even if no long-term assignment is ultimately concluded);

  • the legitimate interests of Peak Legal: the effective delivery of our services to you or our client, the invoicing of our services, the operation of our office, etc., as long as these interests do not conflict with your interests;

  • your consent when we request and obtain it in specific circumstances.

In some cases, we may send you direct marketing (e.g., by email) without your consent. This is the case if we have obtained your electronic contact details in the context of the sale of our services. The direct marketing we send you will always relate to our own similar services. If you do not wish to receive communications from Peak Legal, you can unsubscribe in the communication or email, or contact us via our contact details (see point 1).

5. WITH WHOM DO WE SHARE YOUR PERSONAL DATA? Peak Legal treats your data strictly confidentially. All lawyers are bound by professional secrecy. If your data is shared with employees inside or outside the firm, contractual confidentiality clauses ensure this professional secrecy. Some parties with whom we maintain contact in the exercise of our profession, such as notaries, bailiffs, and accountants, are themselves subject to a specific duty of discretion. Other suppliers or companies that gain access to certain of your data conclude a processor agreement with Peak Legal to ensure the same level of security and confidentiality of your data. This includes the following service providers:

  • Standard software applications for the office: including Microsoft software (Microsoft 365, Outlook, Word, Excel, etc.);

6. MEASURES TO PROTECT YOUR DATA Peak Legal takes all required physical, electronic, and organizational measures to keep your Personal Data safe, accurate, and up-to-date. These measures include:

  • Following newsletters, online information services, and training and seminars concerning our obligations in the field of privacy legislation;

  • Applying administrative and technical controls and restrictions to access your Personal Data;

  • Technical measures in terms of IT security (firewalls, passwords, encryption, etc.);

  • Physical access control to our office.

7. DURATION OF PROCESSING Peak Legal retains your Personal Data for at least the duration of the assignments entrusted to it. Various obligations and protections apply to legal files, such as professional secrecy, professional retention obligations, and the like. There are legitimate interests that allow for the retention of Personal Data after files have been closed. In addition, we also have legal obligations that require us to retain some Personal Data longer. However, this processing of Personal Data will always be limited to what is necessary within the framework of Peak Legal's legitimate interests.

8. RIGHTS OF DATA SUBJECTS: You have the right to inspect your Personal Data free of charge at any time, as well as the use Peak Legal makes of it.

8.1 Right to rectification, erasure, and restriction You always have the right to request Peak Legal to rectify, supplement, or erase your Personal Data. You may also request to restrict the processing of your Personal Data, but this may impact our services. We will inform you further if this situation arises.

8.2 Right to object You have a right to object to the processing of your Personal Data for serious and legitimate reasons. In addition, you always have the right to object to the use of Personal Data for direct marketing purposes; in that case, you do not even need to give reasons.

8.3 Right to data portability You have the right to obtain your Personal Data provided by you to Peak Legal in a structured, commonly used, and machine-readable format and/or to have it transferred to other controllers.

8.4 Right to withdraw consent Insofar as the processing is based on your prior consent, you have the right to withdraw that consent.

8.5 Exercise of your rights You can exercise your rights by contacting Peak Legal's contact person by post, email, or telephone.

8.6 Automatic decisions and profiling The processing of your Personal Data does not involve profiling and will not be subjected to automated decisions by Peak Legal. You always have the right to request human intervention in automated decision-making.
